Traffic fine policy

Guests are responsible for all tickets incurred during their trip. These fines could be related to parking/ speeding/ other traffic offenses. 

REPORTING THE FINE TO DRIVE MATE

As soon as the host receives a fine which they believe happened during a Drive mate trip, then they need to follow these steps:

1. Report the issue to Drive mate via our chat/ email (support@drive-mate.com.au) with the details of the fine and trip ID. If you are unsure of the trip ID, no worries. Just send us the documents related to the fine.

2. Drive mate team will check who had the car at the time and send the host their details in an official "Note to Transfer" so that the host can instruct the issuing agency to reassign the fine (and any associated demerit points) to them.

3. Host will be paid $30 to compensate for the time spent dealing with the fine.

TRANSFERRING THE FINE TO THE GUEST

The instructions for transferring a fine to another driver are usually set out on the fine notice. You should follow those instructions.

You will need:

  • a copy of the fine or penalty notice
  • the Note to Transfer, containing the guest's name, address, date of birth, driver licence number and state or country of issue. We will email this to you after you send us a picture or scan of the fine.

If you are asked to provide more information, forward the request to Drive mate. We will provide further evidence of the responsible party to the issuing authority directly

VICTORIA

The processes below do not apply to parking fines that are issued by a local council. Each council has its own forms and process. Check the fine notice for instructions on how to transfer the fine.

  1. Visit the Fines Victoria Nominate Website
  2. Follow the online prompts to nominate the responsible driver, using the Borrower’s details we sent to you in the Note to Transfer
  3. Retain proof that you have completed the nomination, such as a receipt number or screenshot of the successful submission
  4. If the online form doesn't allow for the attachment of supporting documents, please submit the Note to Transfer through the issuing authority's online enquiry form referencing the penalty or obligation number of the fine.

You must nominate the responsible driver within 28 days of the issue date if the fine is for an excessive speed, drink driving or drug driving offence, or otherwise, before the due date.

If the fine reaches the Notice of Final Demand or Enforcement Warrant stage of the fines lifecycle, you can no longer nominate another driver. You may be able to request a review from Fines Victoria within the 7-day notice period.

NEW SOUTH WALES

  1. Visit NSW Nomination Website
  2. Follow the online prompts to nominate the responsible driver, using the Borrower’s details we sent to you in the Note to Transfer
  3. Retain proof that you have completed the nomination, such as a receipt number or screenshot of the successful submission.
  4. If the online form doesn't allow for the attachment of supporting documents, please submit the Note to Transfer through the issuing authority's online enquiry form referencing the penalty or obligation number of the fine.

You must nominate the responsible driver before the due date of the fine. If you don't nominate the person or nominate them by the due date you may receive a fine for failure to nominate. If the due date has passed you can request a review.

  4. If the online form doesn't allow for the attachment of supporting documents, please submit the Note to Transfer through the issuing authority's online enquiry form referencing the penalty or obligation number of the fine.

You must nominate the responsible driver within 28 days of the date of the infringement notice. If you do not act before the due date you may need to dispute the fine (infringement fines only) in court to have it transferred to the responsible driver

ACT

  2. Follow the online prompts to nominate the responsible driver, using the Borrower’s details we sent to you in the Note to Transfer
  3. Retain proof that you have completed the nomination, such as a receipt number or screenshot of the successful submission
  4. If the online form doesn't allow for the attachment of supporting documents, please submit the Note to Transfer through the issuing authority's online enquiry form referencing the penalty or obligation number of the fine.

TASMANIA

The processes below do not apply to parking fines that are issued by a local council. Each council has its own forms and process. Check the fine notice for instructions on how to transfer the fine.

There is no online nomination service in Tasmania, so you will need to complete a statutory declaration and post it.

  1. Download the statutory declaration form
  2. Complete the statutory declaration using the Borrower’s details that we provided in the Note to Transfer.
  3. Have the statutory declaration witnessed by a Commissioner for Declarations
  4. Take a picture of the statutory declaration and infringement notice for your records
  5. Post the statutory declaration together with your infringement notice and a copy of the Note to Transfer to:

You must nominate the driver responsible for the fine within 28 days of the date of issue on the infringement notice.


SOUTH AUSTRALIA

The processes below do not apply to parking fines that are issued by a local council. Each council has its own forms and process. Check the fine notice for instructions on how to transfer the fine.

There is no online nomination service in South Australia, so you will need to complete a statutory declaration and post or email it.

  1. Download the statutory declaration form
  2. Complete the statutory declaration using the Borrower’s details that we provided in the Note to Transfer.
  3. Have the statutory declaration witnessed by an authorised person (find a JP)
  4. Take a picture of the statutory declaration and infringement notice for your records
  5. Post or email the statutory declaration together with your infringement notice and a copy of the Note to Transfer to:
